4. Blockades, in order to be binding, must be effective, that is to say, maintained by a force sufficient really to prevent access to the coast of the enemy.

כלומר יש הכרח להפעיל את כל האלימות הנדרשת על מנת להבטיח את קיומו של מצור ימי.

כלומר ניתן להשתלט על ספינות ניטראליות אם הן מפרות בדרך כלשהי את הנטראליות שלהן (לדוגמא - ניסיון לפרוץ מצור ימי, לצורך הדיון).

Art. 15. Failing proof to the contrary, knowledge of the blockade is presumed if the vessel left a neutral port subsequently to the notification of the blockade to the Power to which such port belongs, provided that such notification was made in sufficient time.

Art. 17. Neutral vessels may not be captured for breach of blockade except within the area of operations of the warships detailed to render the blockade effective.

Art. 20. A vessel which has broken blockade outwards, or which has attempted to break blockade inwards, is liable to capture so long as she is pursued by a ship of the blockading force. If the pursuit is abandoned, or if the blockade is raised, her capture can no longer be effected.

Art. 21. A vessel found guilty of breach of blockade is liable to condemnation. The cargo is also condemned, unless it is proved that at the time of the shipment of the goods the shipper neither knew nor could have known of the intention to break the blockade.

כלומר (סעיף 15) מניחים שספינה הייתה מודעת לקיום המצור, ולכן גם תישא אחריות על שבירתו, אם יצאה מהנמל לאחר הטלתו. (סעיף 17) ניתן להשתלט על ספינה ניטראלית רק בתוך השטח בו הספינות המממשות את המצור סוגרות (שימו לב - ההגדרה מקיפה וכוללת גם מים טריטוריאליים וגם בינ"ל) (סעיף 19-20) ספינה ששברה, או ניסתה לשבור מצור ימי, ניתן להשתלט עליה, כל עוד ההשתלטות מבוצעת על ידי ספינה השייכת לכוח המטיל את הסגר.

Article 1. The following rules shall govern commerce of war:
(1) Warships of the belligerents have the right to stop and visit on the high seas and in territorial waters that are not neutral any merchant ship with the object of ascertaining its character and nationality and of verifying whether it conveys cargo prohibited by international law or has committed any violation of blockade. If the merchant ship does not heed the signal to stop, it may be pursued by the warship and stopped by force; outside of such a case the ship cannot be attacked unless, after being hailed, it fails to observe the instructions given it.
The ship shall not be rendered incapable of navigation before the crew and passengers have been placed in safety.

מותר לעצור ולבדוק כל ספינה במיים טריטוריאליים או לאומיים (אבל לא במיים של צדדים ניטראליים) כל ספינה בשביל לאמת את זהותה, את חוקיות מטענה או האם היא שברה מצור ימי. קיימת חובה לקרוא לספינה לעצור, אך אם היא מסרבת ניתן להשתמש באלימות. אין לפגוע ביכולת הניווט של ספינה כזו לפני שמובטחים בטחונם של צוותה ונוסעיה.

96. The force maintaining the blockade may be stationed at a distance determined by military requirements.
98. Merchant vessels believed on reasonable grounds to be breaching a blockade may be captured. Merchant vessels which, after prior warning, clearly resist capture may be attacked.
103. If the civilian population of the blockaded territory is inadequately provided with food and other objects essential for its survival, the blockading party must provide for free passage of such foodstuffs and other essential supplies, subject to:

(a) the right to prescribe the technical arrangements, including search, under which such passage is permitted; and
(b) the condition that the distribution of such supplies shall be made under the local supervision of a Protecting Power or a humanitarian organization which offers guarantees of impartiality, such as the International Committee of the Red Cross.

כלומר (סעיף 96) המרחק מהחוף בו מוצב הצי המטיל מצור ימי יקבע רק על סמך צרכים צבאיים. (סעיף 98) מותר להשתלט ספינות שקיים חשש סביר שינסו לשבור מצור ימי. אם לאחר אזהרה סבירה הספינה מתנגדת להשתלטות ניתן לפתוח עליה באש. (סעיף 103) אם האוכלוסיה האזרחית באזור הנתון למצור ימי סובלת ממחסור במוצרים חיוניים, יש לאפשר מעבר של הסחורות החיוניות בתנאים הבאים: (1) למטיל המצור הזכות להגדרת התנאים המדוייקים, כולל חיפוש פיזי על גבי הספינה, (2) חלוקת המוצרים תהיה בידי גוף הומניטרי המסוגל להבטיח חלוקה לא מפלה בין כלל התושבים.

כמו שניתן לראות יש פה גם את הסעיף שבשמו הם יזמו את המשט, גם את ההסתייגויות ממנו (מהם הם התעלמו בניגוד לחוק, כמו תמיד) וגם לא מעט איזכורים, מכל האמנות המנהגיות שהצלחתי לשים עליהן את ידי, שמראים שחוקי לחלוטין להשתלט על ספינה המפרה מצור, גם במים בינ"ל.

כמו תמיד - החוק כתוב בצורה ברורה, ולרוב הוא בעדנו.
