4Law March 2 , 2005 - The U.S. Supreme Court said the Central Intelligence Agency is immune from lawsuits that would reveal the existence of a secret espionage arrangement, throwing out claims by a married couple who say they were Cold War spies. The high court today unanimously ruled against the couple, identified only as John and Jane Doe. The couple said the CIA reneged on a promise of lifetime financial support. The ruling, issued in Washington, overturned a lower court decision. ``Even a small chance that some court will order disclosure of a source's identity could well impair intelligence gathering and cause sources to `close up like a clam,''' wrote Chief Justice William H. Rehnquist, quoting from an earlier case.Rehnquist said the CIA needed ``absolute protection'' from such suits to prevent the ``unacceptable'' possibility that a spy relationship would be disclosed. Justice John Paul Stevens announced the ruling for the absent Rehnquist, 80, who is under treatment for thyroid cancer and hasn't attended a Supreme Court public session since October.
