Court Decision – Fraud in President Election
Ukrainian court lifts ban on disabled people’s voting at home
25.12.2004, 21.00
KIEV, December 25 (Itar-Tass) - Ukraine’s Constitution Court has passed a ruling that lifts the December 8 parliamentary ban on voting at home.
The ban that the parliament endorsed under pressure from the opposition made it possible to cast ballots at home only for the people with Category One disabilities, who are completely unable to move independently.
The Constitution Court said the ban contradicted Ukraine’s basic law since it deprived other people unable to come to the polls, including those on sick leaves, of the right to order delivery of ballot boxes to their homes.
The Court did not answer a petition against another electoral novelty endorsed December 8, which restricts the possibility to vote by absent voters’ ballot to a single polling station in a single constituency.
Experts believe sick or disabled Ukrainians will be able to ask electoral commissions to delivery ballot boxes to their homes during the December 26 repeat runoff presidential election.
The petition was filed with the court by a group of MPs supporting Prime Minister Viktor Yanukovich, who is running in the repeat runoff versus oppositionist Viktor Yushchenko, and by Ukrainian Communists.
They founded their arguments against the ban on the data that several million people, most of them elderly, will be unable to vote December 26 because of complications in the procedure.
The Constitution Court acted promptly by answering the petition just two days after acceptance. Legislation gives it a month-long period to consider such cases.
Yushchenko
UKRAINE'S SBU security service denied today that it had any role in the poisoning of opposition leader Viktor Yushchenko, favourite to win Sunday's rerun of a presidential election. "Due to media reports on the place and time of possible poisoning ... the SBU press service considers it is necessary to state that the SBU had nothing to do with the deterioration of Viktor Andriyovych Yushchenko's health," it said in a statement on its website. The SBU said it had received no official documents providing any evidence of the poisoning or the time or place it happened. It said it would participate in the investigation.
